These general terms and conditions of Martina Ohr, Versandhandel für botanische Artikel, apply to all contracts with customers. An inclusion of customer-specific terms and conditions is not accepted in principle.
The product description contained in the online shop do not constitute binding offers but intended to submit a binding offer by the customer. The customer can send the offer via the integrated shop system while using the order form. By entering your personal data and click the final button to order, the closing of a legally binding contract offer with the selected items is made. Acceptance of the offer by us is done by sending a written confirmation by fax or eMail, or by delivery of the ordered products. The final user (consumer) has a right of cancellation, which is sent with the order confirmation. Details are appropriately regulated there.
The minimum order amount is ¤ 15.00.
Prices and Payment Terms
All prices are final and include the sales tax. Additional Shipping costs are clearly displayed in the shop system before submitting the order and can be shown at any time via a separate link. Customers can choose from several payment options listed in the online shop. Payment in advance or via PayPal is due immediately after closing the contract. With delivery on invoice the total value is due within 14 days from date of invoice on our bank account, without any deductions.
Delay of Payment
The customer is due to my claims without reminder. If the payment goal is exceeded we charge 5.00 Euros per month or reminder, default interest is 8% per year, subject to other legal processes. During processing, combining or mixing our products with other material my property remains and claim is also available on the appreciation of the newly developed product. The pledge and security transfer is prohibited. In delay of payment or a deterioration of assets, we are entitled to demand the immediate return shipments of the goods.
Delivery and Shipping Conditions
The shipping of goods are made to the customer's delivery address. Is a delivery to the customer not possible, customer bears the cost of the failed delivery. This does not apply if the customer refused acceptance by exercising his right of cancellation. Pickup at our location requires an appointment.
Retention of Title
Until payment of the full purchase price and all open costs of business relationship like originating loans, interest and other costs, the goods remain our property.
Applicable Law, Jurisdiction, Contract Language
The laws of the Federal Republic of Germany apply for all legal relationships. Jurisdiction is Rosstal. Contract language is German.
